What Is Gratuity in UAE

UAE Gratuity — End-of-Service Benefit Explained

Gratuity — officially called the End-of-Service Benefit (EOSB) — is a mandatory lump-sum payment that every private-sector employer in the UAE must pay to eligible employees when their employment ends. It is not a bonus or goodwill gesture; it is a legal right governed by Federal Decree-Law No. 33 of 2021. In Arabic, gratuity is known as مكافأة نهاية الخدمة.

The UAE gratuity amount depends on three key factors: your basic monthly salary, your total years of continuous service, and the type of employment contract you held — limited or unlimited. Allowances such as housing and transport are fully excluded from the gratuity formula; only your basic salary counts.

Gratuity is one of the most financially significant entitlements for UAE private-sector workers. An employee earning AED 10,000 per month who works for 10 years can receive over AED 87,000 in gratuity alone — a substantial sum that many employees unknowingly receive less of because they do not verify the calculation before signing their final settlement acknowledgement.

Who Is Eligible for UAE Gratuity?

📅

Minimum 1 Year of Service

You must have completed at least one continuous year of service with the same employer to qualify for gratuity upon resignation. For employer-initiated termination, entitlement may apply before 1 year in specific circumstances.

🏢

Private Sector Employment

Gratuity under Decree-Law No. 33 of 2021 applies to UAE private-sector employees. Government and federal sector employees follow a separate pension and end-of-service framework managed by GPSSA.

Lawful Separation from Employment

Gratuity is payable upon resignation, mutual agreement, employer termination, or expiry of a limited contract. The reason for leaving directly affects the amount you receive — particularly for unlimited contract holders who resign.

🚫

Not Dismissed for Gross Misconduct

Employees dismissed under Article 44 for proven gross misconduct — including theft, fraud, physical assault, or breach of confidentiality — may forfeit their gratuity entitlement. All other termination reasons still qualify in full.

The Official UAE Gratuity Formula

How UAE Gratuity Is Calculated — Step by Step

The UAE gratuity formula is tiered by service duration and uses only your basic monthly salary as the base. Here is the complete official four-step calculation process based on Federal Decree-Law No. 33 of 2021, Article 51:

1

Calculate Your Daily Wage

The UAE gratuity formula uses the daily wage as its base unit. This is derived from your basic monthly salary only. Do not include housing allowance, transport allowance, commissions, annual bonuses, or any other benefit — these are legally excluded from the gratuity calculation under Article 51. Including them is a common calculation error that inflates your figure incorrectly.

Daily Wage = Basic Monthly Salary ÷ 30
Example: AED 12,000 basic salary ÷ 30 = AED 400 per day
2

Apply the Tiered Day-Rate Based on Service Duration

UAE law applies two different day-rates depending on total length of service. The first five years attract 21 days of basic salary per year; every year beyond five years attracts 30 days per year. These tiers are designed to progressively reward long-serving employees more generously.

First 5 Years = Years (up to 5) × 21 days × Daily Wage Beyond 5 Years = Years (above 5) × 30 days × Daily Wage
Example (6 years, AED 400/day): (5 × 21 × 400) + (1 × 30 × 400) = AED 42,000 + AED 12,000 = AED 54,000
3

Apply the Resignation Penalty (Unlimited Contracts Only)

For unlimited contracts, employees who resign receive a reduced gratuity during their first five years of service. This penalty does not apply to limited contracts, to mutual agreement separations, or to employees terminated by the employer. Once you have completed five or more years on any contract type, full gratuity is always payable regardless of who initiates the separation.

Service Duration Reason for Leaving Entitlement
Less than 1 year Any reason Not eligible
1 to 3 years Resigned — unlimited contract ⅓ of full gratuity
3 to 5 years Resigned — unlimited contract ⅔ of full gratuity
5+ years Resigned — unlimited contract Full gratuity payable
Any duration (≥ 1 year) Terminated by employer Full gratuity payable
Any duration (≥ 1 year) Limited contract — any reason Full gratuity payable
4

Apply the 2-Year Maximum Cap

Under Article 51, total gratuity cannot exceed two years of basic salary, regardless of how many years you have worked. This cap applies to the gratuity component only. It does not apply to unused annual leave pay, notice period pay, or unpaid salary days owed in your final settlement — those are calculated separately and are uncapped.

Maximum Gratuity = Basic Monthly Salary × 24
Example: AED 12,000 × 24 = Maximum cap of AED 288,000

Why Your Basic Salary Split Has a Huge Impact on Gratuity

The way your total compensation is split between basic salary and allowances has a dramatic impact on your gratuity — even when your total monthly package is identical. This is one of the most important and least-understood aspects of UAE employment contracts. Always negotiate for the highest possible basic salary component when accepting or renewing a UAE employment offer.

Scenario Basic Salary Total Package Gratuity After 5 Years
Low basic, high allowances AED 5,000 AED 15,000 AED 17,500
Balanced split AED 8,000 AED 15,000 AED 28,000
High basic, low allowances AED 12,000 AED 15,000 AED 42,000

Identical AED 15,000 total package — yet a difference of AED 24,500 in gratuity after just 5 years.

Important UAE Gratuity Rules

Gratuity Rules Every UAE Employee Must Know

⏱️

Gratuity Must Be Paid Within 14 Calendar Days

Under Article 53, gratuity and all final settlement amounts must be paid within 14 calendar days of the last working day — not 14 working days. Employers who miss this deadline face MOHRE financial penalties and can be reported at 800-60 or via the MOHRE smart app.

✍️

Never Sign a Settlement Without Calculating First

Many employers present a final settlement letter at the exit interview. You are not legally required to sign on the spot. Take the document home, calculate your entitlement using this tool, and compare the figures carefully before signing. Signing an acknowledgement of full and final payment significantly limits your ability to claim underpayments after the fact.

📄

Signing an NOC Does Not Waive Your Gratuity

Signing a No-Objection Certificate (NOC) for visa transfer, a standard exit clearance form, or any routine HR document does not legally waive your gratuity rights. Gratuity is a statutory entitlement — it can only be legally waived through a formal settlement signed before a UAE Labour Court, not through routine employer paperwork.

🔍

Employer Deductions Must Be in Writing

Employers may deduct salary advances, company loans, or documented equipment costs from your final gratuity — but only if there is a prior written agreement specifically authorising each deduction. Arbitrary or undocumented deductions are a MOHRE violation. Always request a written itemised breakdown before signing any settlement.

🌐

Most Free Zone Employees Are Covered

Most UAE free zones — including JAFZA, DAFZA, RAKEZ, DMCC, and others — follow the same MOHRE gratuity rules as mainland employers. DIFC employees are covered by the DEWS end-of-service savings scheme instead. ADGM applies modified rules. For all other free zones, this calculator applies directly.

⚖️

What If Your Employer Refuses to Pay?

Gratuity non-payment is a labour violation. File a complaint with MOHRE at 800-60, via the MOHRE smart app, or at mohre.gov.ae. MOHRE typically mediates within days and employers face financial penalties for non-compliance. If mediation fails, the case is referred to the UAE Labour Court where employees with documented entitlements consistently win.

Frequently Asked Questions

UAE Gratuity Calculator — Frequently Asked Questions

Is UAE gratuity calculated on basic salary or total salary?
Basic salary only. Under Article 51, gratuity is calculated exclusively on your basic monthly salary. Housing allowance, transport allowance, commissions, annual bonuses, and all other allowances are fully excluded from the calculation — regardless of whether they appear on your payslip as part of your “salary.” Including them is one of the most common gratuity calculation errors in the UAE.
Do I get gratuity if I resign after 2 years?
Yes, but at a reduced rate on an unlimited contract. After 1–3 years of service on an unlimited contract, you receive one-third (⅓) of the full gratuity amount. After 3–5 years, you receive two-thirds (⅔). After completing 5 years, you receive the full amount regardless of who initiates the separation. On a limited contract, you receive full gratuity for any reason of leaving, as long as you have completed at least one year of service.
What is the maximum gratuity payable in UAE?
Under Article 51, total gratuity is capped at 24 times your basic monthly salary — equivalent to two full years of basic salary. This cap applies regardless of how many years you have worked. Importantly, the cap only applies to the gratuity component itself — unused leave pay, notice period pay, and unpaid salary owed are calculated separately and are not subject to the same cap.
Can my employer refuse to pay gratuity?
No — if you meet the eligibility criteria, gratuity is a legal obligation, not a discretionary payment. If your employer refuses or disputes your entitlement, file a complaint with MOHRE at 800-60, via the MOHRE app, or at mohre.gov.ae. MOHRE mediates rapidly and employers face financial penalties for non-payment. If mediation fails, the case is referred to the UAE Labour Court where documented entitlement claims are regularly upheld.
Does gratuity apply to part-time employees in UAE?
Yes. Under the 2021 Labour Law and Cabinet Resolution No. 1 of 2022, part-time employees in the UAE are entitled to gratuity calculated on a pro-rata basis relative to their contracted working hours compared to a full-time standard schedule. The same service minimums, resignation penalty tiers, and formula steps all apply.
What happens to gratuity if a company closes or goes bankrupt?
Gratuity is treated as a priority debt in UAE insolvency proceedings — employee gratuity claims rank ahead of most other creditors. If your employer closes and cannot pay, file immediately with MOHRE at 800-60 to be registered for priority settlement consideration. MOHRE’s Workers’ Protection Programme and the WPS system also provide additional safeguards for salary and settlement non-payment.
Is UAE gratuity taxed?
No. The UAE has no personal income tax, and gratuity payments are not subject to any form of income or payroll tax for UAE residents. The amount calculated by this tool represents the net amount you are legally owed — there are no tax withholdings to account for when planning your finances around your gratuity payout.
How does gratuity differ from the DIFC DEWS scheme?
The DIFC Workplace Savings Plan (DEWS) replaced traditional gratuity for DIFC employees. Under DEWS, employers make monthly contributions to a regulated fund held in the employee’s name — rather than accumulating a lump-sum liability payable at exit. If you work within DIFC, this calculator does not apply to you. For all other UAE free zones and mainland employers, the standard Article 51 gratuity formula used here applies.
