UAE Gratuity — End-of-Service Benefit Explained
Gratuity — officially called the End-of-Service Benefit (EOSB) — is a mandatory lump-sum payment that every private-sector employer in the UAE must pay to eligible employees when their employment ends. It is not a bonus or goodwill gesture; it is a legal right governed by Federal Decree-Law No. 33 of 2021. In Arabic, gratuity is known as مكافأة نهاية الخدمة.
The UAE gratuity amount depends on three key factors: your basic monthly salary, your total years of continuous service, and the type of employment contract you held — limited or unlimited. Allowances such as housing and transport are fully excluded from the gratuity formula; only your basic salary counts.
Gratuity is one of the most financially significant entitlements for UAE private-sector workers. An employee earning AED 10,000 per month who works for 10 years can receive over AED 87,000 in gratuity alone — a substantial sum that many employees unknowingly receive less of because they do not verify the calculation before signing their final settlement acknowledgement.
Who Is Eligible for UAE Gratuity?
Minimum 1 Year of Service
You must have completed at least one continuous year of service with the same employer to qualify for gratuity upon resignation. For employer-initiated termination, entitlement may apply before 1 year in specific circumstances.
Private Sector Employment
Gratuity under Decree-Law No. 33 of 2021 applies to UAE private-sector employees. Government and federal sector employees follow a separate pension and end-of-service framework managed by GPSSA.
Lawful Separation from Employment
Gratuity is payable upon resignation, mutual agreement, employer termination, or expiry of a limited contract. The reason for leaving directly affects the amount you receive — particularly for unlimited contract holders who resign.
Not Dismissed for Gross Misconduct
Employees dismissed under Article 44 for proven gross misconduct — including theft, fraud, physical assault, or breach of confidentiality — may forfeit their gratuity entitlement. All other termination reasons still qualify in full.
How UAE Gratuity Is Calculated — Step by Step
The UAE gratuity formula is tiered by service duration and uses only your basic monthly salary as the base. Here is the complete official four-step calculation process based on Federal Decree-Law No. 33 of 2021, Article 51:
Calculate Your Daily Wage
The UAE gratuity formula uses the daily wage as its base unit. This is derived from your basic monthly salary only. Do not include housing allowance, transport allowance, commissions, annual bonuses, or any other benefit — these are legally excluded from the gratuity calculation under Article 51. Including them is a common calculation error that inflates your figure incorrectly.
Daily Wage = Basic Monthly Salary ÷ 30
Apply the Tiered Day-Rate Based on Service Duration
UAE law applies two different day-rates depending on total length of service. The first five years attract 21 days of basic salary per year; every year beyond five years attracts 30 days per year. These tiers are designed to progressively reward long-serving employees more generously.
First 5 Years = Years (up to 5) × 21 days × Daily Wage
Beyond 5 Years = Years (above 5) × 30 days × Daily Wage
Apply the Resignation Penalty (Unlimited Contracts Only)
For unlimited contracts, employees who resign receive a reduced gratuity during their first five years of service. This penalty does not apply to limited contracts, to mutual agreement separations, or to employees terminated by the employer. Once you have completed five or more years on any contract type, full gratuity is always payable regardless of who initiates the separation.

Apply the 2-Year Maximum Cap
Under Article 51, total gratuity cannot exceed two years of basic salary, regardless of how many years you have worked. This cap applies to the gratuity component only. It does not apply to unused annual leave pay, notice period pay, or unpaid salary days owed in your final settlement — those are calculated separately and are uncapped.

Gratuity Rules Every UAE Employee Must Know
Gratuity Must Be Paid Within 14 Calendar Days
Under Article 53, gratuity and all final settlement amounts must be paid within 14 calendar days of the last working day — not 14 working days. Employers who miss this deadline face MOHRE financial penalties and can be reported at 800-60 or via the MOHRE smart app.
Never Sign a Settlement Without Calculating First
Many employers present a final settlement letter at the exit interview. You are not legally required to sign on the spot. Employer Deductions Must Be in Writing

Most Free Zone Employees Are Covered
