What Is Leave Salary in UAE

What Is UAE Leave Salary (Annual Leave Pay)?

Leave salary — also called annual leave pay — is the full pay an employee receives during their annual leave period. Under UAE Federal Decree-Law No. 33 of 2021, every private-sector employee is legally entitled to paid annual leave once they complete at least six months of continuous service with the same employer. In Arabic, annual leave is known as إجازة سنوية.

UAE law is explicit on what “pay” means during annual leave: it is your normal salary, not a reduced or partial amount. If you leave the company before using your full leave balance, your employer is legally required to pay out all unused leave days as a cash settlement in your final payment. This entitlement cannot be waived by contract or employer policy.

Who Is Entitled to Annual Leave in UAE?

📅

6 Months Minimum Service

Leave begins accruing at 2 days per month once you complete 6 months with the same employer.

30 Days After 1 Full Year

After completing one full year of service, 30 calendar days of annual leave are due in full.

🏢

Private Sector Employees

Must be employed in the UAE private sector under MOHRE jurisdiction. Government employees follow separate rules.

🚫

Not on Probation

Annual leave does not accrue during the probation period. The clock starts after probation is completed.

The UAE Leave Salary Formula

How Leave Salary Is Calculated in the UAE

1

Calculate Your Daily Salary Rate

UAE leave salary uses your daily rate as the base. Only include allowances (housing, transport) if your employment contract explicitly states they form part of your leave pay. Most contracts base leave pay on basic salary only.

Daily Rate = Basic Monthly Salary ÷ 30
Example: AED 9,000 basic salary → AED 300 per day
2

Apply Your Leave Entitlement

Standard UAE entitlement is 30 calendar days per completed year of service. Some contracts offer more — if yours does, use the custom days option in the calculator above.

Leave Salary = Daily Rate × Leave Days Entitled
Example: 30 days × AED 300 = AED 9,000
3

Subtract Days Already Taken

If you have already used some of your annual leave, the remaining balance is what gets paid out. Days already taken are deducted from the total entitlement first.

Remaining Days = Total Entitlement − Days Already Taken Leave Pay = Remaining Days × Daily Rate
Example: 30 − 8 taken = 22 remaining → 22 × AED 300 = AED 6,600
4

Add Air Ticket Allowance (If Applicable)

Many UAE employment contracts include an annual air ticket allowance as part of the leave benefit. If yours does, this amount is added directly to your leave salary total. It is a contractual benefit — not a legal requirement — so check your offer letter carefully.

Total Leave Pay = Leave Salary + Air Ticket Value

6–12 months 2 days per completed month Up to 12 days
1 full year completed Full entitlement applies 30 days
Each additional month 2.5 days per completed month 30 + (2.5 × extra months)

Important UAE Leave Rules

Annual Leave Rules You Must Know

💰

Leave Salary Must Be Paid Before You Go

Employers must pay your leave salary before the leave period starts — not after you return. Failure to do so violates Article 29 and can be reported to MOHRE at 800-60 or via the MOHRE app. Financial penalties apply to non-compliant employers.

🚫

Unused Leave Cannot Be Forfeited

Unused annual leave days must always be paid in cash on exit. Any contract clause attempting to forfeit unused leave is unenforceable under UAE law. The full accrued balance is payable regardless of your resignation or termination status.

📆

Public Holidays Count as Leave Days

UAE annual leave is measured in calendar days. Weekends and public holidays falling within your leave period count as leave days unless your contract specifically states they are excluded. This is a common point of dispute — check your contract carefully.

📋

Carryover Requires Written Agreement

Employers and employees can agree to carry over unused leave to the next year by written agreement. If no agreement exists, unused leave must be paid out — it cannot simply be cancelled or rolled forward without consent.

⚠️

Employer Cannot Force Leave During Notice Period

Employers may ask employees to take annual leave during the notice period if there is mutual agreement. However, the employer cannot force this without the employee’s written consent. Any such forced leave may still be claimed as a cash payment on exit.

Frequently Asked Questions

Leave Salary FAQs

Is leave salary calculated on basic salary or total package?
Basic salary only in most cases. Allowances are included only if your employment contract explicitly states they form part of your leave pay. If your contract is silent on this, the standard interpretation is basic salary only.
What if my employer doesn’t pay leave salary before I go?
This violates Article 29 of UAE Labour Law. Report it to MOHRE by calling 800-60 or through the MOHRE smartphone app. Financial penalties apply to non-compliant employers, and MOHRE typically mediates quickly on salary payment complaints.
What if I have less than one year of service?
Employees with 6 to 12 months of service accrue leave at 2 days per completed month. On exit, the accrued unused balance is paid out regardless of how long you worked, as long as you have completed at least six months of service.
Can I carry over unused leave to next year?
Employers and employees can agree to carry over leave by written agreement. If no agreement exists, unused leave must be paid out. It cannot simply be cancelled or forfeited — that would be a labour law violation.
Is air ticket allowance mandatory in UAE?
No. An air ticket allowance is a contractual benefit, not a legal requirement. Whether it is included depends entirely on your individual employment contract. Check your offer letter or contract carefully for the specific terms.
Does the leave salary formula apply in free zones?
Most UAE free zones follow MOHRE mainland rules under Federal Decree-Law No. 33 of 2021. DIFC and ADGM have separate employment frameworks with their own leave rules. For all other free zones — including JAFZA, DAFZA, and RAKEZ — the standard Article 29 formula applies.
